RELIEF FROM JUDGMENTS REGARDING COMPETENCY TO STAND TRIAL

A defendant does not generally have a right to appeal a judgment from a hearing on the defendant's competency to stand trial. The defendant only has a right to appeal his or her conviction for the offense with which he or she was charged.

FALSE STATEMENT TO OBTAIN PROPERTY OR CREDIT

A person commits the offense of a false statement to obtain property or credit when he or she intentionally or knowingly makes a materially false or misleading statement to obtain property or credit on behalf of himself or herself or on behalf of another person. The false or misleading statement must be in writing.

Bribery and Financial Institutions

Bribery with respect to financial institutions is a federal offense.

WAIVER OF THE RIGHT TO COUNSEL

Even though a defendant is guaranteed the right to counsel under the Fifth, Sixth, and Fourteenth Amendments to the United States Constitution, the defendant is entitled to waive such right. However, the defendant's waiver must be voluntary, knowing, and intelligent.

Although there is no specific federal statute prohibiting insurance fraud because there is a nexus with interstate commerce, federal prosecution for fraudulent conduct may be sought under a variety of different statutes.
