Civil Litigation

The plaintiff side

The plaintiff files a complaint with the county court clerk. The complaint contains structured statements about something that a defendant has said, done, or failed to do that violates a civil statute. The complaint also describes the legal remedy asked by the plaintiff. The civil court delivers a summons to the defendant with a copy of the complaint.

The defendant side

The defendant receives the summons and the complaint. After that, the defendant files an answer to the complaint with the court clerk within 20 to 30 days. The answer contains admissions or denials to the plaintiff’s structured statements (allegations). The answer also contains written defenses to the allegations.
